It's very tempting to write text in a graphics area, then twist it in
various ways... but I wonder if Catpcha is patented. Is it? Are there
similar things that are outside the patent?

It probably is. People will patent anything no matter how annoying and
useless it may be.
Heck, I wouldn't be surprised to hear someone had patented their own B.O. :)
